Official Rules

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

THIS CONTEST IS IN NO WAY SPONSORED, ENDORSED, OR ADMINISTERED BY, OR ASSOCIATED WITH META PLATFORMS, INC., SNAP INC., OR ANY OTHER SOCIAL MEDIA COMPANY. BY ENTERING THIS CONTEST, YOU ACKNOWLEDGE THAT YOU ARE PROVIDING YOUR INFORMATION TO SPONSOR, WHICH INFORMATION WILL BE SUBJECT TO SPONSOR’S PRIVACY POLICY. INFORMATION SHARED ON SOCIAL MEDIA, WHETHER IN ASSOCIATION WITH ENTRY INTO A CONTEST OR OTHERWISE, REMAINS SUBJECT TO THE APPLICABLE PLATFORM’S PRIVACY POLICY.

1. CONTEST ENTRY PERIOD: JUVÉDERM® LIPS UGC Program (the “Contest”) begins at 9:00 AM ET October 3, 2022 and ends at 11:59PM ET February 6, 2023 (the “Contest Period”). Sponsor’s computer is the time-keeping device for the Contest. Entries received before or after the Contest Period are void.
   
   
2. ELIGIBILITY: The Contest is open only to Allē® Consumer Loyalty Program Members who are legal residents of the fifty (50) United States and the District of Columbia who are at least twenty-two (22) years or older at the time of entry. Void outside the fifty (50) United States, District of Columbia, in states where registration and/or bonding of the contest would be required by law, and wherever else prohibited by law. Licensed Healthcare Providers, Customers, Employees, and Contractors of Allergan, Inc. (the "Sponsor"), and their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies, and the immediate family members (spouses, parents, children, and siblings and their spouses) of, and/or those living in the same household of each, are not eligible to enter. People enrolled in Medicare, Medicaid, or other federal or state healthcare programs are not eligible to enter. People who have been a prize winner in any sweepstakes or contest sponsored by the Sponsor during the 2022 calendar year are not eligible. Allē Members are eligible to win one (1) maximum sweepstakes/contest by Sponsor per calendar year. The Contest is subject to all applicable federal, state, and local laws and regulations.
3. SPONSOR AND ADMINISTRATOR: Allergan, Inc. 2525 Dupont Drive, Irvine, CA 92612.
4. HOW TO ENTER: To participate, you must have an Instagram account. Instagram accounts are free, but subject to Instagram terms of use: https://help.instagram.com/581066165581870. Posting on Instagram requires a mobile device and therefore message and data rates may apply. Message and data rates may apply to use of mobile device to enter the Contest. Your Instagram account settings must be set to "unprotected" and/or "public" for your posts to be viewable by Sponsor. Submitted photos will be viewable to the public on Instagram.com under the hashtags #JUVEDERMLIPSCONTEST and #JUVEDERMLIPS. During the Contest Period, find Sponsor’s post(s) on Instagram advertising this Contest (“Post”). To qualify to enter for the Contest, you must (1) have received treatment in the lips with JUVÉDERM® Ultra XC or JUVÉDERM® VOLBELLA® XC by a licensed specialist at any time within the twenty-four (24) month period prior to the date of your Entry; and (2) be an Allē  member. Once you qualify, take the following action to submit an “Entry” as defined below and become an entrant (each an “Entrant”) in the Contest:
   1. For a chance to win a $400 Allē gift card, post a photo of your JUVÉDERM® Lips on your Instagram account, tag us @juvederm in the photo, include the hashtags #JUVEDERMLIPSCONTEST and #JUVEDERMLIPS in the photo caption, and tag a friend in the caption.  Don't post anything other than the required hashtags and tagging a friend in the caption. Additional content in the caption will disqualify you from the contest. The photo must be a picture of you alone and be your own original work, and no third party may own or control the photo. It may not infringe on any third party’s intellectual property, trademark, copyright, or intellectual rights, or upon any other moral, publicity or privacy rights of any entity or person. The photo must be in its original state and may not have been altered in any way, including by applying filters or by removing, adding, distorting, or reversing any subject within the frame. By taking the action above, you will receive one (1) Entry into the Contest, subject to the Entry limit described below. Sponsor may subsequently disqualify your Entry if it finds your photo and/or associated caption to be unlawful or in violation of these Official Rules. Released Parties (as defined in Section 9, below) are not responsible for lost, late, unreceived, damaged, incomplete, invalid, unintelligible, or delayed photos or captions or failure to receive the photos or captions due to limitations of third-party social media platforms, all of which will be void.
      
      
   2. If your photo is chosen, you must be able to prove you were treated with JUVÉDERM® Ultra XC or JUVÉDERM® VOLBELLA® XC by either: (1) providing treatment records from your licensed specialist; or (2) having your treatment logged within the Allē platform.
5. LIMIT: There is a limit of one (1) Entry per person. All Entries become the property of the Sponsor and will not be acknowledged or returned.
   
   Multiple entrants are not permitted to share the same Instagram account. Moreover, any attempt by any Entrant to obtain more than the stated number of Entries by using multiple/different Instagram accounts, identities, registrations and logins, or any other methods will void all of that Entrant's Entries and that Entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the Instagram account used to register will be deemed to be the Entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses used to create the Instagram account. Each winner may be required to show proof of being an authorized account holder. Participation constitutes Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth in these Official Rules.
6. SPONSOR'S USE OF SUBMISSIONS: Entering this Contest constitutes Entrant’s consent to give Sponsor a royalty-free, irrevocable, perpetual, nonexclusive license to use, reproduce, modify, publish, create derivative works from, and display such Entries in whole or in part, on a worldwide basis, including for commercial use, and to incorporate them into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes. If requested, Entrant will sign any documentation that may be required for Sponsor or its designees to make use of the nonexclusive rights Entrant is granting to use the Entry.
7. PRIZE DRAWINGS: Sponsor will serve as the administrator for the Contest and its decisions as to the administration and operation of the Contest and the selection of the winner are final and binding in all matters related to the Contest. Sponsor will select a panel of judges, who will judge Entries based upon the following criteria:
   
   1. Quality: Entries should have good composition, framing, lighting, exposure, sharpness, etc.
   
   2. Focus on Lips: Entries should showcase results from Entrant’s JUVÉDERM® Ultra XC or JUVÉDERM® VOLBELLA® XC treatment. The subject’s lips should be the central focus of the photo, in clear focus and unobstructed from view.
   
   3. Overall Impression: Entries should promote Sponsor’s brand and brand image.
   
   Judges will select one (1) Contest winner during the Contest Period. Contest winner will be selected from all eligible Entries received during the Contest Period. Winner will be notified by @juvederm via Direct Message on Instagram. To claim the prize (as defined as below), within five (5) days of the date of notice or when attempted notice is sent, the winner must provide their name, mailing address, email address, date of birth, Allē account information, and (where required to prove compliance with these Official Rules), provider records confirming treatment of JUVÉDERM® Ultra XC or JUVÉDERM® VOLBELLA® XC by a licensed specialist to confirm eligibility and for prize fulfillment purposes. Winner may also be required to complete and return any necessary releases and affidavits. If winner cannot be contacted, fails to provide any requested information within the required time period, or the Prize is returned as undeliverable, the winner is disqualified and forfeits their Prize. Receiving a prize is contingent upon compliance with these Official Rules. If a winner is disqualified for any reason, Sponsor will award the applicable Prize to an alternate winner by random drawing from among all remaining eligible Entries. Only three (3) alternate drawings will be held, after which the Prize will remain un-awarded.
8. PRIZES: The following prizes are available to be awarded:1 $400 Allē gift card, which will be deposited directly into the winner’s Allē account (approximate retail value per prize: $400). Total approximate retail value of all prizes: $400. Each Prize is awarded “as is” with no warranty or guarantee, either expressed or implied by Sponsor. SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND/OR NON-INFRINGEMENT. Winner may not substitute, assign or transfer the Prize or redeem the Prize for cash or cash equivalent. Sponsor reserves the right to substitute a Prize for one of equal or greater value if the designated Prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with Prize receipt and/or use. Odds of winning a Prize depend on the number of eligible Entries received during the Contest Period. Limit: One (1) Prize per Entrant. Prize will be fulfilled approximately four (4) weeks after Winner confirmation is complete. No more than the stated number of Prizes will be awarded. Standard Allē program rules and conditions apply. The complete value of the Allē gift card must be used in a single transaction. No balance or refund will be extended for unused portions of the Allē gift card. Allē gift cards may be applied toward the treatment and/or purchase of any products in the Allē portfolio at a participating provider’s office. Allē gift cards can be combined with standard Allē Rewards or offers. Allē gift cards do not expire. Allē gift cards cannot be applied to past transactions. 9. RELEASE: By participating in this Contest, Entrants agree to release and hold harmless Sponsor, Meta Platforms, Inc. and their respective parent companies, subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and Prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, in whole or in part, directly or indirectly arising out of participation in the Contest or receipt or use or misuse of any Prize.
10. PUBLICITY: Except where prohibited, participation in the Contest constitutes the winner’s consent to Sponsor’s and its agents’ use of winner’s name (including, without limitation, winner's Instagram handle), prize information, likeness, Entry, photograph (including, without limitation, winner's Instagram profile photo), voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. Winner may be required to sign an additional release to confirm such use. If you choose to share your winnings on your own social media channel, we ask you to disclose that your post is connected to our contest by including the following hashtags on your posts: #JUVEDERMLIPSCONTEST, #JUVEDERMLIPS #ThankyouJUVEDERM.
11. GENERAL CONDITIONS: Sponsor reserves the right to cancel, suspend, and/or modify the Contest, or any part of it if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. In such event, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible Entries received up to the date of discontinuance for any or all of the Prizes offered herein. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor is not responsible for any lost, late, incomplete, or misdirected Entries. Sponsor is not responsible for any technical, software, or hardware failures which may occur in connection with the Contest, including human errors and problems which limit either submission of Entries or prize fulfillment. Sponsor reserves the right, in its sole discretion, to suspend, cancel, modify, or prematurely conclude the Contest should any computer virus, malfunction, fraud, tampering, unauthorized intervention, or other cause beyond its control affect the administration, security, or proper operation of the Contest, should any portion of the Contest become compromised for any reason. Should Sponsor elect to cancel, suspend, modify, or prematurely conclude the Contest, Sponsor may, at its sole discretion, select a winner from Entries submitted prior to acting or as otherwise deemed fair and appropriate by Sponsor at such time. Sponsor reserves the right to disqualify Entrants who attempt to compromise or undermine the legitimacy of the Contest in any way. Should Sponsor become aware of facts after issuing a Prize that suggest an Entry or Entrant violated these Official Rules, Sponsor may, in its sole discretion, revoke a previously issued Prize.
12. LIMITATIONS OF LIABILITY: The Released Parties are not responsible for:
    1. any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes;
    2. technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software;
    3. unauthorized human intervention in any part of the entry process or the Sweepstakes;
    4. technical or human error which may occur in the administration of the Sweepstakes or the processing of Entries;
    5. late, lost, undeliverable, damaged, or stolen mail; or
    6. any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes or receipt or use or misuse of any Prize. If for any reason an Entrant's entry is confirmed to have been erroneously deleted, lost, not received, or otherwise destroyed or corrupted, Entrant’s sole remedy is another Entry in the Sweepstakes, if it is possible. No more than the stated number of Prizes will be awarded.
13. GOVERNING LAW AND ARBITRATION: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules or the rights and obligations of Entrants, Sponsor, or the Released Parties in connection with the Contest will be governed by and construed in accordance with the internal laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws. The parties hereto each agree to finally settle all disputes only through arbitration; provided, however, the Released Parties shall be entitled to seek injunctive or equitable relief in the state and federal courts in Orange County, California and any other court with jurisdiction over the parties. In arbitration, there is no judge or jury and review is limited. The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. Sponsor and entrant agree that, except as set forth above, any claim, suit, action, or proceeding arising out of or relating to this Contest shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS. If an in-person hearing is required, then it will take place in Orange County, California. The federal or state law that applies to these Official Rules will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate does not apply and the dispute must be brought in a court of competent jurisdiction in Orange County, California. Sponsor agrees to pay the administrative and arbitrator’s fees to conduct the arbitration (but specifically excluding any travel or other costs of entrant to attend the arbitration hearing).
14. PRIVACY; USE OF DATA: The information that entrant provides in connection with the Sweepstakes may be used for Sponsor’s business, marketing, and research purposes and to send entrant information about the Sweepstakes, the Allē program, and other Allergan Aesthetics’ products and services, in accordance with Sponsor’s Privacy Statement, Terms of Use, and California Privacy Policy. By participating in the Sweepstakes, entrant agrees that Sponsor may collect and use entrant’s personal information that entrant provides Sponsor in accordance with Sponsor’s Privacy Statement, Terms of Use, and California Privacy Policy. 
15. WINNER LIST: For the winner list, visit https://juve.io/3E8ddl9. The winner list will be posted on or around February 27th, 2023 or as soon as practicable after confirmation of the final winner is complete.
